Terms of Service

These Terms govern your use of Scrivano. Please read them carefully — by using our Service, you agree to be bound by them.

Acceptance of Terms

By accessing or using Scrivano ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including without limitation individual subscribers, enterprise account holders, and authorized users under organizational accounts.

Service Description

Scrivano provides an AI-powered voice-to-text transcription service that transforms recorded voice conversations into transcribed notes using third-party transcription and AI processing systems, including OpenAI Whisper and GPT-based language models. The Service is accessible via web browser and mobile applications (iOS and Android).

Eligibility & Accounts

You must be at least 18 years of age to use Scrivano. By creating an account, you represent and warrant that you are 18 or older. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Organizations may designate authorized users with appropriate access controls. Notify us immediately at support@scrivano.net if you suspect unauthorized account access.

Beta Status

SCRIVANO'S SERVICES ARE CURRENTLY IN BETA TESTING. Features may change, be modified, or discontinued at any time without notice. The Service may experience downtime, data loss, or unexpected behavior. We do not guarantee that beta features will be available in future versions. By using the Service during beta, you acknowledge and accept these limitations.

Payment & Subscriptions

All fees are denominated in U.S. dollars and are non-refundable except where required by law. Subscription services renew automatically at the end of each billing period unless cancelled at least 30 days before expiration. We reserve the right to modify pricing at any time, with advance notice to existing subscribers. Free credits (5 per day) are provided at our discretion and may be modified or discontinued at any time. Users who provide their own OpenAI API key bypass Scrivano's credit system entirely.

Recording Consent

You are solely responsible for obtaining lawful consent from all parties before recording any conversation using Scrivano. Recording consent laws vary significantly by jurisdiction — many require all-party consent. Failure to obtain proper consent may expose you to civil or criminal liability under applicable wiretapping, eavesdropping, or privacy laws. Scrivano bears no liability for recordings made without proper consent.

User Content & License

You retain full copyright ownership of all recordings, transcriptions, and notes you create through Scrivano. By using the Service, you grant Scrivano a limited, non-exclusive license to host, store, process, and transmit your content solely for the purpose of providing the Service to you. We do not claim ownership of your content and do not use it to train AI models. You are responsible for ensuring you have the rights to any content you upload.

Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Record conversations without the consent of all required parties.
  • Attempt to reverse-engineer, scrape, or benchmark the Service.
  • Use the Service to infringe on third-party intellectual property rights.
  • Distribute malware, spam, or harmful content through the Service.
  • Share your account credentials with unauthorized users.
  • Resell or commercially redistribute the Service without prior written consent.

Dispute Resolution & Arbitration

BY USING SCRIVANO, YOU AND SCRIVANO ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place on an individual basis — class arbitrations are not permitted. This does not prevent either party from seeking injunctive or equitable relief in court for matters involving intellectual property or unauthorized access.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCRIVANO'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO SCRIVANO IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. IN NO EVENT SHALL SCRIVANO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. SCRIVANO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice within the Service. Your continued use of Scrivano after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the Service.
